Social Media Terms and Conditions for Expedia

SOCIAL MEDIA PLATFORMS ARE PUBLIC. IF YOU RESPOND TO OUR QUESTIONS/POSTS OR OTHERWISE POST CONTENT ON OR VIA OUR OFFICIAL BRAND “PRESENCE” ON SOCIAL MEDIA PLATFORMS, WE MAY USE OR REPUBLISH YOUR POSTED TEXT, PHOTO, VIDEO, OR OTHER MATERIALS (collectively “CONTENT”), AS OUTLINED BELOW.

By posting or otherwise making available any Content, or otherwise responding to or communicating with us on or via our official presence on social media platforms/sites and branded hashtags (including, without limitation Facebook, Twitter, Instagram, Pinterest, and Google+ collectively “Social Media Platforms”), you represent and warrant that you are eighteen (18) years of age or older and that you agree to the following terms and conditions:          

You irrevocably grant us, and our affiliates, licensees and assigns, a royalty-free, perpetual, non-exclusive, unrestricted right and license to copy, reproduce, modify, edit, adapt, translate, create derivative works of, publish, post, distribute, publicly perform, or otherwise provide to others your Content in any social medium as permitted by that platform’s terms of use, including advertising and commercial purposes.  You are responsible for reviewing and understanding the terms of use of each Social Media Platform.

In the spirit of “community” and because we want you to be recognized with what is commonly referred to as a “shout-out,” we will try to credit you as the author/source of the Content by referring to your Social Media Platform handle or identifier. By posting, you understand that we may identify you as the author/source of the Content.  Please see our Privacy Statement (https://www.expedia.com/lp/lg-privacypolicy) for more information about how we process your personal information and, where applicable, how you can exercise your privacy rights.

By posting or otherwise making available any Content on our Social Media Platforms, you represent and warrant that the Content does not violate or infringe any rights of any third party, including, but not limited to, copyright, trademark, rights of publicity and privacy. Important Note: If any third-party content or personal information of a third party is included in your posted Content, you must obtain prior permission from that third party and content owner and attribute/credit such content to the owner.  Failure to do so may lead to your personal liability.

Best Practices that will prevent us from deleting and otherwise blocking you.

  • Be nice! Don’t post any Content that is disruptive, abusive, vulgar, profane, obscene, hateful, threatening, harassing, defamatory, or which discloses personally identifiable information or private or personal matters concerning any person. Don’t post any Content that you don’t have the right to post/transmit (and grant us the rights above) under applicable law or under contractual or fiduciary relationship.
  • All testimonials, endorsements and/or advertisements contained in your posted Content must be truthful, accurate and represent your opinion and personal experience.
  • Expedia will not allow for the commercial solicitation or promotion of products and will delete them from the Social Media Platform as necessary.
  • Do not post any personally identifiable information about others, including full names, addresses, credit card numbers, or other personally identifying information.
  • Refrain from using plagiarized content and hearsay. You may not cut and paste from other review sites or travel sources.
  • Ensure that anyone featured in a photograph has agreed you can send it to us to publish on site.  You should not include any photos or information about any third parties without their consent or (in the case of children under 13 years of age) that of their parent or legal guardian.
  • No photos, images, or material that is vulgar, pornographic, obscene, profane, illegal, offensive, insulting, full of personal attacks, objectionable, depicts any nudity, or other non-family-friendly content.
  • No images from other sources or material published elsewhere. And no images that infringe any copyright, trademark, or other legal property right.
  • include viruses or other harmful code that is either intended or may result in damage to the computers, systems, and services of Expedia; and/or

All comments and postings are subject to the social media platform’s Terms of Use. You agree to hold Expedia, Inc. (sometimes referred to herein as “us” or “our”) and our subsidiaries, affiliates, and each of their respective officers, directors, employees and agents (collectively, “Indemnitees”) harmless, and defend and indemnify the Indemnitees (at Indemnitees’ election) from any claims, disputes, demands, proceedings, cause of action, judgments, damages, liabilities, losses, costs or expense of any kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed which may arise out of or are in any way connected with your posted Content and/or your use of our official brand presence on Social Media Platforms.

These terms shall be governed by and construed in accordance with the laws of the State of Washington without giving effect to principles of conflict of laws. In no event will we be liable hereunder for punitive, consequential, direct or indirect damages, including lost profits.
